Terms and Conditions
The Terms and Conditions ("T&C") of GBR Event Vendéglátóipari és Rendezvényszervező Korlátolt Felelősségű Társaság (registered office: 1146 Budapest, Ajtósi Dürer sor 5. 1. floor. 1. door 1, tax number: 28741844-2-42), as a service provider ("Service Provider"), for the use of its webshop. Please use our services only if you agree with all of its points and consider them binding for you. This document is not filed, is concluded in electronic form only (it does not constitute a written contract) and does not refer to a code of conduct.

Basic provisions
1.1 The most common terms used in these Terms and Conditions are:
Service provider: A GBR Event Kft., amely a www.gundel.hu oldalon termékeket értékesít.
User: Any person over the age of 16 who has access to the content of www.gundel.hu.
Client: the User who registers on www.gundel.hu creates a user account, thereby accepting the www.gundel.hu Terms and Conditions. For natural persons, registration is subject to the age of 16 years.
Customer: the Client who places an order via the user account on www.gundel.hu.
User account: the User can create his/her own user account by registering on www.gundel.hu, by entering his/her name, e-mail address and password, which is the only condition for placing an order. The user account will contain the data and information provided by the Customer during registration and when placing the order(s), as well as the order number associated with the order. The User is responsible for the accuracy of the information provided by him/her.
Website: The Service Provider's website www.gundel.hu.
Webshop: On www.gundel.hu, the online trading portal operated by the Service Provider
1.2 Hungarian law shall govern the matters not regulated in these Rules and the interpretation of these Rules, in particular with regard to the relevant provisions of Act V of 2013 on the Civil Code ("Civil Code") and Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The mandatory provisions of the relevant legislation shall apply to the parties without any specific stipulation.
1.3 GBR Event Kft., as the operator of the online shop available on the website, reserves the right to unilaterally modify these Terms and Conditions of Service. GBR Event Kft. will inform its Users of the modification in the form of a short information notice, which may be included in the dedicated interface of the website, in the newsletter sent by GBR Event Kft. or in the notification sent to all registered Users to the e-mail addresses they have provided. An amended version of the Terms of Service will be published on the website. We recommend that you read the Terms of Service published on the website before making any purchase.
1.4 Copyrights are regulated by Act LXXVI of 1999, Article 1 of which states that the website, including the webshop operated on the website, is a copyright work, on the basis of which the website and the webshop operated on the website are protected by copyright.
Pursuant to Article 16 (1) of Act LXXVI of 1999, the author, in this case the Service Provider, has the exclusive right to make any use of the work in whole or in part, or any identifiable part thereof, in material or non-material form, and to authorise each and every use. On this basis, any use of any visual, audio or written content on the website without the written permission of the Service Provider is PROHIBITED.
1.5 The Service Provider undertakes to operate the webshop with an availability of at least 98.0% per year. The calculation of availability does not include pre-announced maintenance, downtimes due to system development, as well as downtimes caused by extraordinary and force majeure events beyond the control of the Service Provider.

Range of products available for purchase
1.7 Products displayed on the webshop interface can be purchased in person with or without online ordering.
1.8. In the webshop, the Service Provider shall display the name and description of the product in detail, and shall display a photo of the product. The pictures displayed on the product data sheets may differ from the real ones, in some cases they are used as illustrations, in which case the User is provided with clear information.
1.9 The prices of the products include VAT and packaging charges, but do not include delivery charges.
1.10. If a special price is introduced, the Service Provider shall fully inform Users on the webshop interface about the duration and conditions of the promotion.
How to order
1.11. Through the Website, the Customer may place an Order electronically by adding the selected product(s) to the Cart, selecting the quantities of the products, and providing the billing information. The placing of the Product(s) in the Cart does not constitute finalisation of the Order.
After accepting these Terms and Conditions, the Customer can finalise the Order by clicking on the Order button.
By finalizing the Order, the Customer declares that the data provided by him/her are true and correct. By finalising the Order, the Customer undertakes to pay the Order in the manner of payment indicated by him.
1.12. Placing an Order does not result in the conclusion of a contract between the Service Provider and the Customer. The Service Provider's webshop shall confirm the receipt of the Customer's order to the Customer electronically within 48 hours. If this confirmation is not received by the Customer within a reasonable period of time from the date of sending the Customer's order, depending on the nature of the service, but no later than 48 hours, the Customer shall be released from the obligation to make an offer or contractual obligation. The order and its confirmation shall be deemed to have been received by the service provider or the Customer when it becomes available to him.
1.13. In the case of alcoholic beverages, the Service Provider shall only sell to the Customer/Customer quantities not exceeding the commercial quantity specified by law. The Service Provider shall not sell alcoholic beverages to persons under the age of 18. The Service Provider shall be entitled to request the Customer to provide appropriate, credible proof of age at the time of personal receipt of the product.
Payment method
1.14. Online purchases in the webshop can only be made by credit card payment through the OTP SimplePay system. The types of cards accepted by the Service Provider are displayed on the webshop interface before the payment data is entered.
The Seller may - with simultaneous notification to the Customer and without legal consequences - cancel the Customer's Order in the following cases:
- if the Customer has selected an online payment method and the issuing financial institution does not authorise the transaction.
- if the Customer has selected an online payment method and the online payment partner is unable to validate the transaction.
The order shall be deemed to be a contract concluded by electronic means and shall be governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services.
By placing an order on the Website, the Customer acknowledges that sales through the Website are made exclusively to end users. Any resale or resale for commercial purposes of products purchased through the Website is prohibited.
Order processing and fulfilment
1.15. The processing of orders will start within 24 hours after the confirmation is sent. The Customer will not be informed of this separately.
1.16. The general delivery period is 5 working days from the date of confirmation, within which the purchased product is ready for collection. If the Service Provider and the Customer have not agreed on the time of fulfilment, the Service Provider shall be obliged to fulfil the contract within the time or date specified in the Customer's request, or in the absence of a request, within 30 days of the receipt of the order by the Service Provider at the latest.
1.17. If the Service Provider fails to fulfil its contractual obligation because the product specified in the contract is not available, it shall immediately inform the Customer thereof and refund the amount paid by the Customer without delay, but no later than within thirty days. The fulfilment of this obligation shall not relieve the Service Provider of any other consequences of its breach of contract.
1.18. Products purchased in the webshop can only be collected in person In the case of personal collection and personal purchase - without online ordering - the address of the shop selling the products and the place of collection is Gundel Restaurant and Café, 1146 Budapest, Gundel Károly út 4. In the case of orders not placed online, we recommend that you enquire about the availability of the selected product at the telephone number or e-mail address provided in the Service Provider's details section. Products purchased on the website can be collected during the opening hours of the restaurant as indicated on the website.
The Customer must check the quantity and quality of the ordered Product(s) without delay after delivery or receipt.
The Service Provider shall provide the invoice to the Customer electronically.
Right to withdraw
1.19. Under the provisions of Government Decree 45/2014 (II.26.) on the detailed rules of contracts between the Customer and the Service Provider, the Customer may withdraw from the contract within 14 days of receipt of the ordered product without giving any reason, and return the ordered product.
1.20. The Customer may exercise his/her right of withdrawal by using the declaration template that can be downloaded from the webshop or by sending an unambiguous declaration to the Service Provider by e-mail or by post. The declaration must clearly indicate the Customer's intention to withdraw. The Customer may return the ordered product to the Service Provider in person, in the original condition in which it was purchased, with its packaging, at the place of receipt, which is an essential condition for the refund of the price of the product to the Customer. The cost of returning the product shall be borne by the Customer.
In the case of a cancelled order, the refund will be reimbursed to the financial institution that issued the credit card upon the Service Provider's request to the online payment partner.
Guarantee, warranty
1.21. Our products are subject to the warranty, accessory warranty and product warranty provisions of Act V of 2013 on the Civil Code.
Complaints handling
1.22. The Customer may submit a complaint to the Service Provider at the following contact details of the Service Provider, exclusively in writing.

The Service Provider shall cooperate with the Customer in the amicable settlement of consumer complaints and disputes.
1.23. In accordance with the provisions of Act CLV of 1997 on Consumer Protection, if any consumer dispute between the Service Provider and the Customer is not resolved during negotiations with the Service Provider, the Customer may apply to the conciliation body competent in the place of his/her residence or domicile and initiate the proceedings of the body, or may also apply to the conciliation body competent in the place of the Service Provider's registered office. In the conciliation procedure, the primary means of conducting hearings is online. The Customer is also entitled to request a personal hearing.

1.24. In proceedings with a value of less than HUF 200,000, the Service Provider is bound by the decision of the Arbitration Board, according to which if the online shop does not comply with the decision, the Customer may request the court to issue an enforcement clause to the decision, on the basis of which the Customer may initiate enforcement proceedings against the Service Provider operating the online shop.
Miscellaneous provisions
1.25. The Service Provider and the Customer shall try to settle their disputes amicably.
The User and the Service Provider stipulate the jurisdiction of the Central District Court of Pest for any disputes within the scope of these Terms and Conditions that cannot be settled by agreement within 30 (thirty) calendar days.
